In the event that the accused denies the offense or has given a counter-denial in accordance with section 123, the court may order a discussion between the plaintiff and the defendant to determine what should be decided in the case.
(2) In the case of a case in which the plaintiff, the defendant and the Government of Nepal are plaintiffs, the accused must also be present in the court on the day the discussion is ordered according to sub-section (1) and if the accused so wishes, his legal practitioner can also be present.
(3) In the discussion according to sub-section (1), the plaintiff can present the claim and the defendant can present the counterclaim and the related evidence.
(4) According to sub-section (3), the court may determine the matters to be decided in the case from the claims, counterclaims and evidence submitted by the plaintiff and the defendant.
